1. Acceptance of Terms
By creating an account, accessing, or using any feature of the Tengra Akademi platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Service. These Terms constitute a legally binding agreement between you and Tengra Teknoloji ("Company").
2. Eligibility
You must be at least 18 years old to create an account and use the Service independently. Users aged 13–17 may use the platform only with verifiable parental or legal guardian consent. By using the Service, you represent that you meet these eligibility requirements.
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use. Tengra Akademi reserves the right to suspend or terminate any account that violates these Terms or is involved in suspicious activity. One person may maintain only one active account.
4. Services & Content
Tengra Akademi provides online educational courses, live coaching sessions, and related digital learning materials. Course availability, pricing, and content may change at any time. We make commercially reasonable efforts to ensure content accuracy but do not guarantee specific learning outcomes or professional certifications unless explicitly stated.
5. Pricing, Payment & Subscriptions
All prices are displayed on the platform in the applicable currency and include VAT where required by Turkish law. Payment is processed at the time of purchase through our secure payment partners. Subscription plans auto-renew unless cancelled at least 48 hours before the next billing cycle. You may cancel auto-renewal at any time from your account settings. Price changes for subscriptions will be communicated at least 30 days in advance.
6. License to Use Content
Upon purchasing a course, you are granted a limited, non-exclusive, non-transferable, revocable license to access and view the course content for personal, non-commercial educational purposes. This license does not grant you ownership of the content. You may not download, record, reproduce, distribute, or create derivative works from any course content unless explicitly permitted.
7. Prohibited Conduct
You agree not to: (a) share your account credentials with others; (b) use bots, scrapers, or automated tools to access the platform; (c) attempt to circumvent DRM, copy-protection, or access controls; (d) upload malicious code or interfere with platform operations; (e) harass, abuse, or threaten other users or instructors; (f) post misleading reviews or fraudulent content; (g) use the platform for any unlawful purpose. Violation of these rules may result in immediate account termination without refund.
8. Intellectual Property
All content, trademarks, logos, software, and platform design are the exclusive property of Tengra Akademi and/or its content creators. Instructors retain ownership of their educational materials and grant Tengra Akademi a license to distribute them through the platform. No part of the Service may be reproduced, republished, or redistributed without prior written consent.
9. User-Generated Content
By submitting reviews, comments, forum posts, or other content ("User Content"), you grant Tengra Akademi a worldwide, non-exclusive, royalty-free license to use, display, and distribute such content in connection with the Service. You represent that your User Content does not infringe any third-party rights. We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant uninterrupted or error-free access. Educational content is for informational purposes and does not constitute professional advice.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Tengra Akademi's total liability to you for any claims arising out of or related to the Service shall not exceed the total amount you paid to us in the 12 months preceding the claim. We shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of data or profits. Nothing in these Terms limits liability for fraud, gross negligence, or matters that cannot be limited by law.
12. Dispute Resolution & Governing Law
These Terms are governed by the laws of the Republic of Turkey. Any dispute arising from these Terms or the use of the Service shall first be submitted to the competent Consumer Arbitration Committee (Tüketici Hakem Heyeti) for claims under the statutory threshold, or to the Istanbul Courts and Enforcement Offices for claims above that threshold. Mandatory consumer mediation (arabuluculuk) requirements under Turkish law apply where applicable.
13. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. You may delete your account at any time through your account settings. Upon termination, your license to access purchased content ceases, except as required by applicable refund or data retention laws.
14. Force Majeure
Tengra Akademi shall not be liable for any failure or delay in performing its obligations due to causes beyond its reasonable control, including but not limited to natural disasters, pandemics, government actions, internet outages, cyberattacks, or utility failures.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a notice on the platform at least 30 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance. If you disagree with the changes, you must stop using the Service and may request account deletion.
